What is the Statute of Limitations in a Personal Injury Case Law


Statute of limitations is the legal term that describes the time frame in which a plaintiff can pursue legal action against a liable party or parties. In Texas, the statute of limitations for personal injury cases is two years, yet exceptions do exist.

Statutes of limitations vary from state to state and can be from one to six years. These statutes may also be highly dependent on the circumstances of the injury. A common exception to the statute of limitations in Texas personal injury cases occurs when a minor has been injured. Since a child cannot make legal decisions while still, a minor, Texas state law allows an extension, effectively giving a minor until the age of 20 to pursue legal action.

Some exceptions can be granted due to lack of common knowledge, or the fact that an injured person was not aware that they had a legitimate personal injury claim.

Extenuating circumstances, such as an injury that causes a victim to lapse into a coma lasting longer than two years, can be cause for an extension.

Reasonable circumstances may also contribute to an extension being granted. However, neither laziness nor ignorance can be construed as reasonable circumstances. A victim that was unaware that a lawsuit could be filed would likely not be able to claim ignorance as to the basis for receiving an extension.
